Senator Susan Rubio Advocates for Tenant Protections Amid Wildfires, Preventing Those Sharing Rental Housing from Being Evicted
SACRAMENTO, CA - After touring shelters across Southern California and hearing firsthand accounts of the struggles faced by vulnerable individuals, urgent action has been taken to prevent more Californians from falling into homelessness.
During visits to local shelters, Senator Susan Rubio (D- Baldwin Park) spoke with survivors who fear being forced onto the streets due to restrictive lease policies that threaten their stability. One survivor shared that her father and brother lost their home in the Eaton fire, but that her rental property survived. She was fearful over losing her housing if she brought them into her apartment, as her landlord has stated that she would be in violation of the rental agreement by housing extra people. “These stories are not isolated; they reflect the growing crisis facing our communities” said Senator Rubio.
“Recognizing the gravity of the situation, I brought these concerns directly to Governor Newsom. I am grateful for his swift response, which resulted in an Executive Order addressing these challenges head-on. Homelessness is preventable, and we have a responsibility to act” she added. As the legislature works to strengthen protections through legislation, this order provides an interim solution to provide immediate relief and clarity to protect tenants and survivors.
The Executive Order prohibits landlords from using the unlawful detainer process – a legal process landlords use to evict tenants who violate their lease – to evict a tenant for violating a term of their lease that would otherwise prohibit them from sheltering one or more people displaced by the recent emergency. The order does not prohibit landlords from enforcing other lease terms, such as those regarding criminal activity or property damage. The order is in effect until March 8, 2025.
